1. Agreement to these terms

These Terms of Service (the “Terms”) govern your access to and use of the website at rollproof.com (the “Site”) and your purchase of any products from ROLLPROOF LLC, a California limited liability company (“ROLLPROOF,” “we,” “us” or “our”). By using the Site or placing an order, you agree to these Terms. If you do not agree, please do not use the Site.

You must be at least 18 years old, or the age of majority in your jurisdiction, to place an order.

2. Our products

ROLLPROOF sells protective mats that shield a vehicle’s paint and trim from contact during wheelchair transfers and when loading equipment such as strollers, bikes and sports gear. We try to display product details, colors and dimensions as accurately as possible, but we do not warrant that descriptions or images are error-free, and actual products may vary slightly. All measurements are approximate.

3. Product use & safety

ROLLPROOF products are protective accessories for your vehicle. By purchasing and using them you acknowledge and agree to the following.

Not a medical device. ROLLPROOF products are not medical devices, transfer aids, mobility aids or load-bearing equipment. They are not designed or intended to support a person’s body weight or to assist a transfer. Always follow safe transfer techniques recommended by your clinician or occupational therapist.

You are responsible for installing and using the product correctly, including keeping magnetic mounting components clear of your vehicle’s door and trunk sealing surfaces so that doors and lids close normally.

4. Orders, pricing & payment

  • All prices are shown in the currency displayed at checkout and are subject to change without notice.
  • Placing an order is an offer to buy. We may accept or decline any order, and may limit or cancel quantities purchased per person or per order.
  • We reserve the right to correct any pricing or description errors, and to cancel affected orders, even after an order is confirmed.
  • Payment is processed by our third-party payment providers (including Shopify Payments and, where applicable, Stripe, PayPal or Shop Pay). You represent that you are authorized to use the payment method you provide.

5. Shipping & delivery

Shipping timeframes, costs and destinations are described in our Shipping Policy, which forms part of these Terms. Title and risk of loss pass to you upon delivery to the carrier.

6. Returns & warranty

Returns, refunds and our limited warranty are described in our Refund, Returns & Warranty Policy, which forms part of these Terms.

7. Disclaimer of warranties

Except for the limited warranty expressly stated in our Refund, Returns & Warranty Policy, the Site and all products are provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

8. Limitation of liability

To the fullest extent permitted by law, ROLLPROOF and its owners, members, officers and suppliers will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, data, goodwill, vehicle value, or damage to property or persons, arising out of or relating to your use of the Site or any product. Our total liability for any claim will not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnification

You agree to indemnify and hold harmless ROLLPROOF LLC and its owners, members and agents from any claim or demand, including reasonable legal fees, arising from your breach of these Terms or your misuse of any product.

10. Intellectual property

The ROLLPROOF name, logo, product designs, text, graphics and Site content are owned by or licensed to ROLLPROOF LLC and are protected by intellectual-property laws. You may not copy, reproduce or use them without our prior written permission.

11. Governing law & disputes

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules.

Informal resolution first. Before starting an arbitration or any legal proceeding, you agree to contact us at contact@rollproof.com and give us at least 30 days to resolve the matter informally. Most concerns can be settled this way.

Binding arbitration. If we cannot resolve a dispute informally, you and ROLLPROOF agree that any dispute, claim or controversy arising out of or relating to these Terms, the Site or any product (a “Dispute”) will be resolved by final and binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except as stated below. Arbitration may take place in California or, at your election, by telephone, video or written submissions. Judgment on the award may be entered in any court having jurisdiction. This agreement to arbitrate is governed by the Federal Arbitration Act.

Class-action waiver. You and ROLLPROOF agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated or representative proceeding. The arbitrator may not consolidate more than one person’s claims or preside over any class or representative proceeding.

Exceptions. Either party may bring an individual claim in small-claims court, and either party may seek injunctive or other equitable relief in court to protect its intellectual property.

Your right to opt out. You may opt out of this arbitration agreement within 30 days of first accepting these Terms by emailing contact@rollproof.com with your name and a statement that you decline arbitration. Opting out will not affect any other part of these Terms.

If this arbitration agreement is found not to apply to a Dispute, that Dispute will be decided exclusively by the state or federal courts located in California, and you consent to their jurisdiction. To the fullest extent permitted by law, you and ROLLPROOF waive any right to a jury trial.

12. General

  • We may update these Terms at any time; the “Last updated” date shows the latest version, and continued use means you accept the changes.
  • If any provision is found unenforceable, the remaining provisions stay in effect.
  • Our failure to enforce any right is not a waiver of that right.
  • These Terms, together with our Privacy, Shipping and Refund policies, are the entire agreement between you and ROLLPROOF.
